PROTECTION OF PERSONAL DATA AND INFORMATION SECURITY
NORMATIVE FRAMEWORKS
Rojales City Council is governed by the protection of personal data and information security, mainly through the following regulatory frameworks:
Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, concerning the protection of natural persons with regard to the processing of their personal data and the free circulation of these data (RGPD hereafter ).
Organic Law 3/2018 of December 5, Protection of Personal Data and guarantee of digital rights (LOPDGDD hereafter).
Royal Decree 3/2010 of December 8. National Security Scheme (ENS onwards).
Royal Decree 951/2015, of October 23, of modification of Royal Decree 3/2010, of January 8, which regulates the National Security Scheme in the field of Electronic Administration.
Regulatory developments, instructions, directives, norms and standards in force at all times regarding the protection of personal data and information security.
Based on the first additional provision of LOPDGDD – Safety measures in the field of public sector – this City Council adopts the National Safety Scheme as a normative frame of reference in terms of safety measures applicable in LOPDGDD, in addition to its own general applicability on the services and information of the City Council, whether or not they treat personal data.

Purposes
Management of administrative procedures and activities carried out by the City Council in the exercise of its powers and obligations.
Automated decisions are not made based on profiles.
Conservation of data
Your data will be kept during the period established by the treatment, the applicable legislation and the requirements applicable to the preservation of information by the Public Administration.
Legitimation / Applicable legal bases
The different municipal procedures and activities involve treatments based on different legal bases listed in the RGPD:
Consent of the interested person, when required.
Contractual relationship
Vital interests of the interested party or of other persons.
Exercise of public powers conferred on the controller and / or fulfillment of a legal obligation applicable to the controller.
Development of the municipal competences conferred by the state and autonomic legislation regulating the local regime.
Basic meaningful legislation:
Law 7/1985, of April 2, Regulating the Bases of the Local Regime.
Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.
Law 40/2015 of October 1, on the Legal Regime of the Public Sector.
Specific legislation of municipal services. It depends on each treatment.
Legal bases 4 and 5 cover practically all municipal treatments, but the rest can be legitimating and / or complementary to specific treatments, in which this circumstance will be specifically indicated on your form (party’s request) or in your communication ( ex officio).
Recipients
Your data may be communicated to the public and / or private entities competent, intervening or necessary for the processing of procedures and / or management of municipal activities, and in the cases provided for by law.
Rights
You can exercise your rights of access, rectification, deletion, opposition, limitation of the treatment, portability and (where appropriate) withdrawal of the consent given. Also, you can contact the Control Authority to claim your rights.
To exercise these rights, you must send an application to the Town Hall of Rojales, Entrance Register, Carrer del Malecon de La Encantá, 1, 03170 Rojales, Alicante, indicating “Delegate of Data Protection”.
This request can be made through:
1) Ordinary mail. Recommended (not mandatory) certified mail.
2) Instance in person or at Electronic Headquarters.
3) Email addressed to: dpd@rojales.es
In all cases, the City Council must verify their identity as the owner of the data. For this verification, you can choose between these two options:
Provide a photocopy of a document proving your identity (DNI, NIE, Passport).
Express your consent so that the City Council can verify your identity telematically (unnecessary in case of an application filed at the Electronic Office), for which you must indicate your name and surname, the type of document for consultation (DNI, NIE) and your number. In case of unavailability of telematic services, you must provide a photocopy of the document proving your identity.
International transfers.
No international data transfers are made. In specific cases where necessary, the corresponding authorization will be requested from the Control Authority.
